Good morning CuP Alloys 1,

That is exactly the problem i dont know of anyone who has resolved a similar situation although a good few have been affected, in fact if you follow the thread back it stretches to 2010.

I decided it was probably not prudent to throw good money after bad in a legal pursuit of my deposit .

I think this has been mentioned before, but it is worth noting:

It is a matter of public record that the Limited Company '05482721' was dissolved in 2009.

I have no knowledge of the basis upon which "Cheddar Valley Steam" has traded since then.

Hi Michael.

Im not sure but I think this may have the the original Cheddar Valley Steam Ltd before Tim was involved but I stand to be corrected on that one.

The date when you paid your money is a bit of a clue!


If it was paid to a company that was not limited the debt is still live and recoverable.

This is based on personal experience!

Clevedon Steam is run by Jerry Watson,

He worked for Cheddar Models for several years until their demise and started his business in 2006 after Cheddar folded.

Might be worth contacting him as he may well be able to confirm the up to date situation with regard to Tim.

I am reliably informed that Tim is no longer in business.

i have reached the stage of life that if I have lost a deposit , unless it is of a significant amount, I just write it off as the time and effort to recover it does not appeal. Probably the wrong attitude some will say.

Well in my case my money was paid in June 2016, but surely it is likely that the company has no money and therefore any judgement in your favor still couldn't be paid??

I must admit that is the way I looked at my situation the deposit was just over £200 and I considered it would be easy to spend that much on recovery

If you paid CVS (not limited) you paid an individual trading as CVS. If that individual has money or assets you can recover that money through the County Court.
Keep your sense of humour and enjoy the sport. You can get your money back.

I spent 41 years working in corporate insolvency, bankruptcy and debt collection.

If only it were that simple.

Golden rule no.1 is to find out if Tim whateverhisname is actually in liquidation (a company) or bankruptcy (sole trader), or he has merely ceased trading and not paying back deposits. This is important, since it will be dealt with in totally different ways.

The second step will be to find out if he has any assets. If he hasn't, you will be better going outside and banging your head on the wall, the outcome will be kinder.

Almost guaranteed is that if he owes one person money, he will owe others.

In a liquidation or bankruptcy, secured debtors will be paid first from any assets, secured including any lenders, HMRC etc.

Only then will ordinary creditors (such as people that paid a deposit) be paid, and they will rank pari passu (equal) to each other for any dividends that may be paid - frequently the payout in a simple insolvency will only pay back a few pence in the pound, and that will probably take at least a couple of years.

Just banging in a Money Claim Online claim for the money is a waste of time if there no assets, since even if a judgement is made against Tim, you can't enforce it if he has no assets; and this is only the way to approach it if he isn't bankrupt.

With my background I would be the last person to say 'don't bother' when pursuing charlatans, but anyone owed £200 has to make a valued judgement if they want to spend this and more in their time and fees, and equally with my background I would be the first to say check if there are any assets you can go after BEFORE starting proceedings, as it may be a waste of time.

Thanks for that Keith I think that sums up my thoughts entirely id rather spend my money on the replacement boiler which is due later this year from another source

I'm not sure whatever happened a decade ago helps anyone that has had their deposit trousered today.

What it does tell me, however, is that as lightning has now struck at least twice, it would appear that Tim whatsisname is incapable of running a viable business, something people might like to take into consideration if he pops up elsewhere (as 'Phoenix' businesses often do).

As I have not lost any money to "Tim" I really have no interest in the matter; but if I was in that situation, I would be investigating thoroughly, for reasons that I'm sure you will understand.
